At its meeting on Tuesday evening, the Livingston Planning Board unanimously voted to adopt a resolution to approve a new Housing Element and Fair Share Plan. Board chairman Peter Klein explained that under state law, every community must meet its fair share of the affordable housing needs of its region. The Council on Affordable Housing (COAH) established rules for this process and there have been two rounds of compliance under those rules. COAH was recently determined by the New Jersey State Supreme Court to be "non-functioning" and Livingston's obligations are now being determined by the court.
