Township Council Passes Ordinances, Resolutions

The Livingston Township Council introduced its final new ordinance of the year and passed several others at its Monday, December 6, meeting. The meeting was held virtually and may be viewed on the Livingston Township, NJ Facebook page.At the start of the meeting, the Council noted that residents should expect to receive another notice about PFAS levels in the township water. Though nothing has changed, the township is required to send out a notice every quarter until it is remedied. Later in the meeting, township manager Barry Lewis said he expected remediation to cost as much as $10 million or more, some of which may be recouped through legal action and government funding.The Council also said that a cannabis subcommittee of the Planning Board is expected to be introduced at the start of the New Year.CDBG HearingThe second of two hearings were held for the Community Development Block Grant (CDBG), which allows the township to apply for a portion of Essex County’s HUD funding.The program is designed to benefit those with moderate to low incomes and Livingston is limited in what it can apply for as a result. A recent grant from the program allowed the township to install automatic doors at the Livingston Police Department to make it ADA accessible.There were no public comments made.Passed OrdinancesAn amendment to township code section 170-106.1, titled “RIAO Inclusionary Adult Residential Overlay District,” was passed. Among the changes to the code are the maximum number of dwelling units allowed per building (changing from 99 to 125), and that developers must make “good faith efforts” to incorporate green building features.Mayor Shawn Klein said what could be built as a result of the ordinance is “not a great project for the town, but unfortunately the town is stuck doing it,” due to the agreement with Fair Share Housing. The ordinance was passed unanimously, with Klein abstaining.Also passed was an ordinance to authorize the sale of a portion of the Licari Open Space-purchased property to contiguous property owners. Licari is located off of East Northfield Road on block 7300, lots 68, 82, and 83. The ordinance was passed unanimously.Another ordinance was passed, to authorize the sale of a portion of the Strahman Open Space-purchased property to contiguous property owners. Strahman is located off of East Cedar Street on block 2504, lot 23 and block 166, lots 45 and 46. The ordinance passed unanimously.Two ordinances were passed ...
